DUI stands for driving under the influence, but it’s not a term often used in New York, where DWI and DWAI are more common. DWI stands for driving while intoxicated, while DWAI indicates that someone is driving while “ability impaired.” This way, the charge can apply to either alcohol or other substances, like prescription drugs, marijuana or illegal drugs.

Types Of DWI Violations In New York

A DWI violation in New York is when a driver has a BAC over .08%. The limit is lower for commercial drivers, at just .04%. Aggravated driving while intoxicated is used for a very high BAC of at least .18%. Driving while ability is impaired can be used for either alcohol or drugs, or a combination of the two. Finally, drivers can choose to refuse breath tests or chemical tests, but doing so is a violation of implied consent laws and can lead to a license suspension.

New York’s “Zero Tolerance” Law

New York uses a zero tolerance law for underage drivers. Those under 21 years old can get a DWI if their BAC reaches or exceeds .02%, far below the traditional legal limit of .08%.
